No one likes being caught speeding. But if you have, then you will want to know what happens next.

Firstly, you will receive a Notice of Intended Prosecution through the post. You will then need to fill in the form. The following options are guidelines of how to fill out the form. Simply click on the relevant part that refers to you and it will show you which section of the form will need to be completed.

When completing the response form please print in BLOCK CAPITALS using one character per white square

The form (page 3) must be completed, signed and returned ONLY by the person or a company representative, to whom it is addressed.

As the recipient of the notice, you are required under Section 172 of the Road Traffic Act, 1988, to provide the requested information by completion of the response section which must be signed. Failure to do so within the time limit specified on the attached document will render you liable for prosecution.

ADVICE AND GUIDANCE FOR COMPLETION OF THE FORM:

Completion by private individual. (Registered Keeper)

If you are a private individual and have identified yourself as the driver at the time of the alleged offence, you must check that your details are correct in the notice header (page 3 of the documentation).

Complete Part 1 and place a tick in the box provided stating ‘I was the driver at the time of the alleged offence’.

If you were the driver at the time of the offence and would like to be considered for a Driver Awareness Course as an alternative to a fine and 3 penalty points, please tick the box indicated in Part 1. (if you are not eligible for the Driver Awareness Course then you will not see this option)

Tick Part 1a if you were the driver at the time of the offence and would like to take part in the fixed penalty scheme.

Tick Part 1b if you were the driver at the time of the offence and would like the matter will be dealt with by way of a court hearing.

Once Part 1 is complete you should enter your driver number, current number of points, the date you have completed the form and your date of birth into the fields provided.

Once these details have been complete you should sign the document in the space provided.

If your details are incorrect then you should complete Part 1c in full.

If you were not the driver at the time of the offence and therefore need to nominate another person as the driver, do not give them the form to complete. You must instead complete

Part 2 of the form only, providing their details and sign Part 2 of the document in the space provided. We will then write to them in due course. Please supply as much detail as possible.

Completion by a company (Registered Keeper)

It is the responsibility of the Company Director / Secretary to complete this document, not the driver concerned. If you are the company director or Secretary then you will need to complete Part 2

Notes

Do not give this form to the nominated driver, but complete Part 2 supplying the driver’s details. We will then correspond with that driver. You should supply the residential address of the individual and not a c/o address. Please check that your address records are correct before completion of the document.

Keepers liability

It is a legal requirement of the registered keeper of the vehicle to supply information requested, failure to do so may result in court proceedings. Liability cannot be evaded.

Driving Licence details

It is vital that you supply the correct driver number. If you do not hold a DVLA Swansea issued licence then please indicate this on the response document and supply a photocopy of the licence held. If you have lost or mislaid your licence we advise you to apply immediately for a replacement. Forms can be obtained from the Post Office giving you full details of how to obtain a replacement licence.

If you have 9 penalty points or more

If you were the driver at the time of the offence and have 9 or more valid penalty points on your licence, the Fixed Penalty Scheme cannot be entered into and a court hearing will be arranged for the matter to be dealt with. However, you must still complete this notice.

Video &/or Photographic evidence

This is not supplied as a matter of routine, however it may be used in any subsequent court hearing.

Correspondence.

Correspondence will not be entered into. 

The Notice of Intended Prosecution is required to establish who the driver was at the time of the offence. Therefore, payment and driving licence documents are not required at present. PLEASE DO NOT SEND THESE WITH YOUR RESPONSE.
