On 1 December 2003 it became illegal to use a hand-held mobile phone, or similar device (excluding two-way radios) whilst in charge of a motor vehicle. The definition of a hand-held mobile phone is any device which performs an interactive communication function by transmitting and receiving data (excluding a two-way radio).

The reasoning behind this legislation comes from numerous studies which have proven that using such devices are a considerable distraction and significantly increases the risk of the driver causing or being involved in an collision.

Did you know that it is also an offence to cause or permit someone to use a mobile phone whilst driving? This also means it is an offence for someone who is supervising a provisional licence holder to use a mobile phone whilst the learner is driving.

The responsibility is not just on the driver. If you receive a call or make a call to someone who you know is in-charge of a motor vehicle, you should hang up and call them later. Employers also need to be aware of these laws as causing an employee to use a mobile phone whilst driving is an offence with a hefty punishment.
