Frequently asked questions relating to the Chideock Westbound safety camera 1. What is the issue relating to speed limit enforcement on the A35 in Chideock? A Crown Court judgement has found that the Traffic Regulation Order (TRO), which defined a length of the A35 in Chideock, West Dorset, as subject to a 30mph speed limit, was defective between 1997 and 2007 as it mistakenly referred to the A35 junction with "Seatown Road", when it should have been "Duck Street". Unfortunately, as a result of this historical clerical error in the TRO, the speed limit was not able to be enforced at that point on the A35 between 1997 and 2007. 2. Does this mean that the speed limit should not be 30mph in Chideock? No - the speed limit in Chideock is 30mph and the defective Traffic Regulation Order was replaced on the 13th November 2007. No one has suggested that the speed limit here should be anything other than 30mph or that it is sensible to drive faster than 30mph through the village. 3. Does this mean that drivers detected speeding by the westbound safety camera in Chideock will have their fixed penalty fine refunded and penalty points removed from their licence? Each case will be reviewed individually and may result in the motorists detected travelling over 30mph on the westbound safety camera in Chideock, prior to 2007, having the fixed penalty fine from this offence refunded and the related penalty points removed from their driving licence (if still valid). 4. Does this judgement affect my speeding offence from Chideock? This only affects drivers detected speeding by the westbound (travelling towards Exeter) safety camera on the A35 in Chideock between 1997 and 2007. 5. From mid-July, the Dorset Safety Camera Partnership will be writing to all drivers affected to inform them of the situation and outline the process to follow. 6. What should I do if my speeding offence is affected? If your speeding offence is affected, you should receive a letter from the Dorset Safety Camera Partnership by the end of November 2009. However, if you have not yet received a letter and wish to request a refund of the fixed penalty fine and the removal of penalty points from your driving licence, please download the form from this website and send it to us along with your driving licence (you should take a photocopy for your records prior to sending your licence). 7. Why is it only speeding offences detected by the westbound safety camera that are affected? The Traffic Regulation Order is only necessary to cover the 30mph zone on the A35 in Chideock where there is no system of street lighting. There is one safety camera within the stretch of road covered by the TRO and it only monitors the traffic travelling west, towards Exeter. The safety camera monitoring vehicles travelling eastbound is within a stretch of road with a system of street lights and is therefore subject to a 30mph speed limited under the rules of the Highway Code and is unaffected by this ruling. 8. Why is it only speeding offences between 1997 and 2007 that are affected? The defective TRO was arranged in 1997. The TRO has been rewritten with the correct road name and this came into force on 13th November 2007, so speeding offences after this date are not affected by this ruling. 9. My speeding offence is affected, however my contact details (and/or name) have changed since the speeding offence – how can I inform you? If your name and/or address have changed since your speeding offence, please complete the downloadable form to request a refund of the fixed penalty fine and the removal of penalty points from your driving licence. Please include your details at the time of your offence as well as your new details – as specified in the form. 10. I am the relative or friend of a driver who had a speeding offence at Chideock however they have since passed away – what should I do? The Dorset Safety Camera Partnership will be writing to all drivers whose details we have on record. In cases where the driver has since passed away, the fixed penalty fine can be reimbursed to their estate. If you wish to request the fixed penalty fine be reimbursed to the estate of your relative or friend please complete the form and return it with an enclosed letter which indicates this situation and include the contact details for the estate of the deceased. 11. I was convicted in court of a speeding offence at Chideock during this period – what should I do? Further information will be provided shortly for drivers detected exceeding the speed limit travelling westbound on the A35 in Chideock, West Dorset, and as a result of this were later convicted in court of a speeding offence. 12. I have sent a completed form requesting a refund of the fixed penalty fine – how long will it take for the refund to be issued? A refund should be issued to drivers where we can verify fines having been paid within six months of the Dorset Safety Camera Partnership receiving your completed form. 13. I have sent a completed form requesting the removal of penalty points from my licence and a copy of my driving licence – how long will it take for my driving licence to be returned? The DVLA are responsible for removing points and it is hoped that they would process licences within three months of receipt of the licence. 14.
