Update on response to the case of Regina v Dawe - A35 Chideock:

The Highways Agency is instructing a QC to review the case and provide a legal opinion.  This opinion, which will include the potential for this judgement to be applied to other cases, is expected to be with the Highways Agency by 26th January 2008.  Further updates will be provided when the Highways Agency advises the Dorset Strategic Road Safety Partnership of its position.

The Dorset Safety Camera Partnership and its partners at Dorset Police appreciate that some people are interested in the applicability of the judgement to their own circumstances.  However, the decision on whether there will be a process to refund any fixed penalty fines and remove penalty points from driving licences remains one for the Ministry of Justice (MoJ).  The MoJ is likely to await the legal opinion before making this decision.

The Dorset Safety Camera Partnership and Dorset Police will publicise the final decision.
